Privacy Policy and Notice on the Processing of Personal Data

Planar Systems, Inc., together with our holding company(ies), affiliates, subsidiaries and other properties we own, operate or manage (together, “Planar”, “we” or “our”), respect the privacy of every individual for whom personal data is collected or who uses any of our websites (together, these websites are the “Planar Site”).

This Privacy Policy applies to personal data that:

  • is provided to us when you (including a third party acting on your behalf) makes an inquiry or purchase; and;

  • we collect from you when you visit any Planar Site or which we obtain from any communications with you.

The following sections of this Privacy Policy describe the types of personal data we collect, how we collect that personal data, for what purposes we use that personal data, with whom we share it, and the choices and rights available to you regarding our use of your personal data. We also describe the measures we take to protect the security of the personal data we hold, and how to contact us about our privacy practices and exercise your rights. We will process personal data in accordance with applicable law.

TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOUR USE OF THE PLANAR SITE WILL BE DEEMED CONSENT TO THE COLLECTION AND USE OF YOUR PERSONAL DATA IN ACCORDANCE WITH THE TERMS OF THIS PRIVACY POLICY.

1. Data Controller 
Data Controller Planar is the data controller with respect to your personal data. 

2. Personal Data We Collect

2.1 Personal Data You Provide on a Voluntary Basis
We will collect, store and process information about you if you voluntarily provide us with such information in collection with the following: 

  • filling in a form on any Planar Site;

  • filling in a physical registration card;

  • opting in to receive marketing information with us;

  • creating an on-line account with us and managing your preferences;

  • contacting us by telephone or face to face (e.g. in the context of making an inquiry or purchase);

  • sending us a letter, e-mail, social media message, or similar communication;

  • subscribing to receive a service from us (e.g. a newsletter, blog or by following us on social media);

  • requesting promotional information from us (e.g. information about any of our products or services);

  • participating in a survey or promotional program; or

  • contributing content to us (e.g. product suggestions or blog responses).

The types of information we may obtain include:

  • name, address, email address, telephone number

  • purchase, delivery, installation of products or services;

  • reviews and opinions about our brands, products and services;

  • information we receive about you from any third parties through whom you have made inquiries or purchases or to which you have provided information or consented to the collection of such information, such as resellers and distribution partners.

Use of certain features of the Planar Site requires you to complete a registration procedure which requires you to provide certain personal information, such as your name and email address.

You may submit personal information to Planar by using the Support Center feature of the Planar Site. Information which you submit in this manner will be subject to the terms contained in our Terms of Use Agreement also on this page and at https://www.planar.com/legal/.

2.2 'Special Category' Personal Data
We do not collect personal data which is, by its nature, particularly sensitive (e.g. personal data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, genetic data, biometric data for the purpose of uniquely identifying a natural person, data concerning health or data concerning a natural person’s sex life or sexual orientation) unless it is volunteered by you or collecting such data is subject to an exception under applicable law for legitimate purposes.

2.3 Personal Data We Collect Automatically 
When you visit the Planar Site, we may also collect certain data through the use of “cookies” and other automated means. Cookies are small pieces of data that are stored by your browser on your computer's hard drive that can transmit your data to us. We use both session ID cookies and persistent cookies. A session cookie terminates automatically after you close your browser. A persistent cookie remains on your hard drive, but it can be removed by following the directions on your browser. You can set your browser to disable cookies, but this may prevent you from enjoying all of the features of the Planar Site. Unless you have adjusted your browser setting so that it will refuse cookies, or declined to accept cookies through the Planar Site’s pop-up request, the Planar Site will issue cookies when you visit or log on to the site. We use cookies to gather data about the visitors to the Planar Site, to enable us to improve the Planar Site, products, and services, and to deliver a better and more personalized service. From time to time, we may use an outside agent to collect user information. The collection and use of such information will be for purposes substantially identical to those described above. As part of this service, the outside agent may use cookies.

Data we collect through such means may comprise the following:

  • Date and time;

  • originating IP address;

  • domain name;

  • type of browser and operating system used (if provided by the browser);

  • URL of the referring page (if provided by the browser);

  • object requested;

  • completion status of the request;

  • geographic location; or 

  • language preferences.

2.4 No Personal Data of Children
Planar does not sell products to persons under the age of 18. If you are under the age of 18, you are required seek the approval of your parent or guardian to purchase products from the Planar Site. The Planar Site is not intended for use by children under 13 years of age under any circumstances. Planar does not knowingly collect personal information from children under 13 years of age.

3. Use of Personal Data
As a worldwide provider of technology, Planar has a legitimate business interest in operating and improving its business and the products and services it offers. Planar therefore uses and processes your personal data to:

  • help us create content that is relevant to Planar Site visitors and customers;

  • make improvements to the Planar Site and social media pages and ensure that content is presented in the most effective manner;

  • provide you with information, products or services that you request from us or which we feel may interest you, including delivering better user experiences based on prior browsing behavior;

  • facilitate administrative processes related to your inquiry or purchase;

  • assess and help us understand general trends and patterns relating to our business;

  • provide for the safety, security, and satisfaction of our customers;

  • manage general record keeping;

  • enable us to compile anonymous, aggregated statistics that allow us to understand how users use the Planar Site and to help us improve the structure of the Planar Site;

  • enable you to purchase and make payments for products and services;

  • meet any legal and/or regulatory requirements;

  • provide the products or services you request from us; and

  • improve our business, products, and services and ensure our products and services are of interest to you.

We may also use your personal data to protect against and prevent fraud, claims, and other liabilities and to comply with or enforce applicable legal requirements, industry standards, and our policies and terms. We use personal data for these purposes when it is necessary to protect, exercise or defend our legal rights, or when we are required or permitted to do so by applicable law.

In the situations set out below, we will only process your personal data when you have given us your specific consent and you have the right to withdraw your consent at any time:

  • marketing and profiling purposes which are managed solely by Planar Systems, Inc. as data controller for Planar. Your decision to provide your data for such purposes is optional and will have no consequence on your ability to stay with us or benefit from the requested services;

  • all purposes concerning a specific product or services purchase, in relation to Planar Systems, Inc.’s processing of the relevant personal data by another member of Planar which collects that data.

Your decision to provide personal data (including special category/sensitive personal data) to us is voluntary, however, if you do not provide such personal data which is required by us, you may not be able to benefit from our products and services, and we may not be able to provide the products and services you purchased. We may process your personal data by both automated and manual means. We may use your personal data in other ways for which we provide specific notice at the time of collection or for which we are permitted under applicable law.

4. Sharing Personal Data
We do not sell, otherwise disclose, or share data we collect and hold about you, except as described in this Privacy Policy.

We may share your personal data with third parties as described below:

  • other members of Planar or our affiliated companies, which may use this data to offer products and services to you consistent with the purposes identified in this Privacy Policy;

  • third party service providers who have been appointed as data processors to perform functions and services on our behalf and who will be provided only with personal data necessary to perform the services on our behalf but are not authorized by us to use such data for any other purposes (e.g. providers of services in respect of web hosting, payment processing, information technology systems, customer relationship management, service scheduling management, marketing, auditing, security, administration);

  • third party providers of data aggregation and analytics software services, which may include Google Analytics, for which use is governed by the Google privacy policy located at www.google.com/policies/privacy/partners.

  • third party providers of components or portions of any product or service we arrange for you;

  • third party websites and features linked from the Planar Site, as further described in Paragraph 9 - Links to other websites and features.

  • our advisors and insurers in the event of a claim, dispute or where otherwise necessary;

  • if we are required or permitted to do so by law or pursuant to legal process or to comply with any applicable rules or regulations, or in response to a legitimate request from a law enforcement authority or other government official; and

  • we reserve the right to transfer personal data about you in the event that we sell or transfer all or a portion of our business or assets, in accordance with applicable law. Should such a sale or transfer occur, we will use reasonable efforts to direct the transferee to use data you have provided to us in a manner that is consistent with this Privacy Policy. Following such a sale or transfer, you may contact the entity to which we transferred your data with any inquiries concerning the processing of that data.

5. Your Rights
We will only send you marketing communications if you previously consented or “opted in” to receiving such communications. You have the right to “opt out” of receiving marketing communications, whether by email or otherwise, at any time. You can do this by (i) clicking the unsubscribe link displayed in any of the marketing e-mails you receive, (ii) emailing marketing@planar.com to indicate you no longer wish to receive marketing communications, or (iii) writing to us at the relevant address set out in Paragraph 12 “How to contact us.”

Pursuant to California's "Shine the Light Act", California residents are permitted to request information about the manner in which we share certain categories of data with third parties for their marketing use.

If you are a “data subject” under applicable data protection law in the EU or United Kingdom, you will have the following rights in relation to personal data that we hold about you:

  • Right to Access - to request confirmation of whether we process personal data relating to you, and if so, to request a copy of that personal data;

  • Right to Rectification - to request that we rectify or update any personal data that is inaccurate, incomplete or outdated;

  • Right to Erasure - to request that we erase your personal data in certain circumstances, such as where we collected personal data on the basis of your consent and you withdraw your consent;

  • Right to Restriction of Processing - to request that we restrict the use of your personal data in certain circumstances, such as while we consider another request that you have submitted, for example a request that we update your personal data;

  • Right to Withdraw Consent - where you have given us consent to process your personal data, to withdraw your consent; and

  • Right to Data Portability - to request that we provide a copy of your personal data to you in a structured, commonly used and machine readable format in certain circumstances.

To exercise your rights as set out above or to make a complaint or submit an inquiry about our privacy practices, please contact Planar by (i) email at marketing@planar.com, or (ii) writing to us at the relevant address set out in Paragraph 12 “How to contact us.”

To help protect your privacy and maintain security, we may take steps to verify your identity before we can action your request.

6. Data Transfers
We may transfer to, and store the data we collect about you in, countries other than the country in which the data was originally collected, including the United States, Canada or other destinations outside the European Economic Area (“EEA”) and the United Kingdom. Those countries may not have the same data protection laws as the country in which you provided the data. When we transfer your data to other countries, we will protect the data as described in this Privacy Policy and comply with applicable legal requirements providing adequate protection for the transfer of data to countries outside the EEA and outside the United Kingdom.

If you are located in the EEA or the United Kingdom, we will only transfer your personal data if:

  • the country to which the personal data will be transferred has been granted a European Commission adequacy decision; or

  • we have put in place appropriate safeguards required by applicable law in respect of the transfer.

7. How We Protect Your Personal Data
We maintain administrative, technical and physical safeguards designed to protect the personal data you provide against accidental, unlawful or unauthorized destruction, loss, alteration, access, disclosure or use, as required by applicable law. The nature of electronic transmission means that we cannot guarantee that our security measures will always be effective. Therefore, any transmission is at your own risk. Where Planar provides you with (or where you have chosen) a password that enables you to access certain parts of the Planar Site, you are responsible for keeping the password confidential.

For your own protection, we encourage you not to include sensitive personal data, credit card or similar personal data in any e-mails you send us or our staff.

8. How Long We Keep Personal Data
Planar only retains your personal data for as long as needed to fulfill the purposes for which it is collected, unless we are required or permitted by law to keep the personal data for longer. Planar generally retains payment and credit card data for 2 years. Other data is generally retained for 7 years, or longer if your account remains open and active or based on our legitimate interest or legal purposes, such as network improvement, fraud prevention, record-keeping or enforcing our legal rights.

We may anonymize or delete your personal data if your last interaction with Planar was over 7 years ago. “Interaction with Planar” includes, for example, visiting the Planar Site.

Please note that Planar WallDirector Cloud is hosted by a third-party provider Xyte to provide you with services described. By using Planar WallDirector Cloud you also agree to be bound by Xyte’s privacy policy available here. When using WallDirector Cloud you may choose to provide and store the following categories of information in addition to information outlined in Section 1:

  • Contact information, including names, company names, addresses and email addresses;

  • Commercial information including payment information, credit card information, billing and shipping information;

  • Geolocation data based on your IP address and electronic network activity related to your interaction with the services;

  • Information about your products registered with the service, including audit logs and reports on product performance;

  • Information about chosen integrations with other applications or services; and

  • Information related to your service requests and product requirements.

Information you provide through WallDirector Cloud will be stored within the WallDirector Cloud and may be accessed from time to time by Planar or its affiliates as part of Planar’s provision of service. Further, if you elect to integrate WallDirector Cloud with other third-party applications or services you use your data will be governed by third party privacy policies and by integrating WallDirector Cloud with any other applications or services, you will agree to bound by the applicable third-party terms of service.

Please note that the Planar Site (www.planar.com) may use YouTube API Services and Vimeo for any Planar product videos. By accessing those videos, you agree to be bound by the YouTube Terms of Service (https://www.youtube.com/t/terms), and the Vimeo Terms of Service (https://vimeo.com/terms).

10. Updates to Our Privacy Policy
This Privacy Policy may be updated periodically and without prior notice to you to reflect changes in our processing of your personal data and privacy practices. We will post a prominent notice on each of Planar’s websites to notify you of any significant changes to our Privacy Policy and indicate at the top of the Privacy Policy when it was most recently updated. Alternatively, we may contact you with notice or otherwise provide notice in a manner permitted by applicable law. The personal data Planar collects and maintain will be subject to the version of this Privacy Policy in effect at the time of collection. Your continued use of the Planar Site after notification of such changes has been posted shall constitute your assent to be bound by these changes and the revised Privacy Policy as a whole.

11. California Consumer Privacy (California Residents only)
